Terms & Conditions

These Terms & Conditions apply to the use of the Territory Day Fireworks website and the purchase of products from Territory Day Fireworks, operated by Vitu Corp Pty Ltd ABN 50 297 748 646.

By using this website or placing an order, you agree to these Terms & Conditions.


1. Eligibility to Purchase

You must be at least 18 years old to purchase fireworks.

We may refuse sale or collection of fireworks to any person who:

  • is under 18 years of age;
  • appears intoxicated or under the influence of drugs;
  • behaves aggressively or unsafely; or
  • we reasonably believe intends to use the products unlawfully, including transporting fireworks outside the Northern Territory.

Fireworks may only be sold during the legal sales period permitted under Northern Territory law.


2. Orders and Payment

All prices are listed in Australian dollars (AUD).

For online pre-orders:

  • orders are considered confirmed at 9:00am on Territory Day unless cancelled before that time;
  • payment must be completed through our approved payment methods unless otherwise agreed in writing.

For in-store purchases, we accept cash, EFTPOS, and most major credit cards. Other payment methods may be accepted at management discretion.

All goods remain the property of Territory Day Fireworks until paid in full.


3. Pre-Orders, Collection and Supply

All fireworks sold by Territory Day Fireworks are sold for collection within the Northern Territory only.

We do not mail, courier, freight, or ship fireworks interstate or internationally.

Pre-orders must be collected:

  • during the legal sales period; and
  • within the collection times provided during checkout or order confirmation.

Customers are responsible for ensuring collection, transport, storage, and use of fireworks complies with all applicable laws.

Orders not collected by 7:00pm on Territory Day may be treated as abandoned unless otherwise agreed by management.

Where an order is abandoned without notice, no refund will be payable.

Customers who cannot collect their order are encouraged to contact us as early as possible so we can attempt to assist.


4. Pre-Order Cancellations and Refunds

These cancellation terms apply to online pre-orders only.

Customers may cancel a pre-order without penalty before 9:00am on 1 July.

We request that cancellation requests be made as early as possible, preferably before 5:00pm NT time on 28 June, to allow us time to resell reserved stock.

After 9:00am on 1 July, fireworks have generally been allocated, packed, or reserved specifically for customer orders, and we may no longer be able to resell those products.

Where a customer contacts us after this time:

  • we will attempt to resell the products where reasonably possible; and
  • any refund will be reduced by reasonable resale, handling, and restocking costs.

In many cases, these costs may be up to 50% of the original order value.

Where a customer fails to collect an order and does not contact us, no refund will be payable.

Nothing in these Terms excludes rights under Australian Consumer Law.


5. Product Availability and Substitutions

We make every reasonable effort to:

  • accurately manage stock levels;
  • only sell products we reasonably believe are available; and
  • pack all customer orders correctly.

However, errors and stock shortages can occasionally occur.

If an item in your order is unavailable, incorrectly packed, or otherwise cannot be supplied, we may provide a substitute product of equal or greater value that is reasonably consistent with the type and intended use of the original item ordered.

Our preference is always to ensure customers receive suitable replacement products and leave satisfied with their purchase.

Where a suitable substitution cannot reasonably be provided, we will offer a refund for the affected item.


6. Promotions, Competitions and Giveaways

From time to time, Territory Day Fireworks may conduct promotions, competitions, giveaways, prize draws, coupon code offers, or similar activities through this website, social media, radio advertising, email marketing, or other channels.

Additional terms may apply to specific promotions and will be published where relevant.

We reserve the right to verify the validity of entries, orders, purchases, coupon codes, and participant details, and may disqualify any person who:

submits false or misleading information;
creates multiple accounts or identities;
uses automated entry methods;
attempts to manipulate, abuse, or gain an unfair advantage in a promotion; or
otherwise acts contrary to the intended operation or spirit of the promotion.

Where entry is linked to an order, purchase, coupon code, or promotional code, we may refuse, invalidate, or remove entries associated with cancelled, refunded, fraudulent, or unpaid orders.

Unless otherwise stated, prizes are not transferable, exchangeable, or redeemable for cash.

We reserve the right to substitute a prize with another prize of equal or greater value where reasonably necessary.

Our decisions regarding eligibility, winner selection, prizes, and the operation of any promotion are final.

We reserve the right to amend, suspend, cancel, or recommence any promotion where reasonably necessary to ensure its fair operation or due to circumstances beyond our reasonable control.


7. Fireworks Safety and Product Performance

Fireworks are explosive articles and must be handled, stored, and used responsibly and strictly in accordance with all laws, instructions, and safety directions.

All fireworks sold by Territory Day Fireworks are supplied in accordance with applicable Australian standards and legal requirements. However, customers acknowledge that fireworks are manufactured products involving pyrotechnic compositions and may occasionally:

  • fail to ignite;
  • experience delayed ignition;
  • perform differently than intended; or
  • malfunction despite meeting applicable testing standards.

Customers must take appropriate safety precautions at all times, including maintaining safe distances from people, buildings, vehicles, dry vegetation, and other hazards.

To the maximum extent permitted by law, Territory Day Fireworks accepts no liability for injury, loss, or damage arising from:

  • misuse of fireworks;
  • unlawful use;
  • failure to follow safety instructions; or
  • malfunctions or performance variations inherent to pyrotechnic products.

Nothing in these Terms excludes rights or guarantees that cannot legally be excluded under Australian Consumer Law.


8. Legal Use of Fireworks

Customers are responsible for ensuring fireworks are used only:

  • during legally permitted times;
  • in legally permitted locations; and
  • in compliance with all applicable laws and permit requirements.

Territory Day Fireworks is not responsible for unlawful transport, possession, storage, or use of products after collection.


9. Limitation of Liability

To the maximum extent permitted by law:

  • all warranties not required by law are excluded; and
  • our liability is limited to replacement, repair, or refund of the affected product.

We are not liable for indirect or consequential loss, including loss of profits, business interruption, or data loss.

Nothing in these Terms excludes rights or guarantees that cannot legally be excluded under Australian Consumer Law.


10. Website Use

You must not misuse this website, attempt unauthorised access, or interfere with website functionality.

We may suspend or restrict access to the website at any time without notice.

Links to third-party websites are provided for convenience only. We are not responsible for third-party content or privacy practices.


11. Privacy

Our collection, use, and handling of personal information is governed by our Privacy Policy available on this website.


12. Intellectual Property

All website content, including text, images, logos, branding, and graphics, is owned by or licensed to Territory Day Fireworks and may not be copied or reproduced without written permission.


13. Force Majeure

We are not responsible for delays or failure to perform obligations caused by events outside our reasonable control, including natural disasters, supplier shortages, government restrictions, power outages, or transport disruptions.


14. Changes to These Terms

We may update these Terms & Conditions from time to time.

The latest version will always be published on this website.


15. Governing Law

These Terms & Conditions are governed by the laws of the Northern Territory of Australia.

Any disputes are subject to the jurisdiction of the courts of the Northern Territory.
